Terms of Service
These terms govern your use of soundkin (“the Service”). By logging in or otherwise using the Service, you agree to them.
1. Eligibility
You must be at least 13 years old (or the age of digital consent in your jurisdiction, whichever is higher) and a Spotify account holder to use soundkin.
2. Your account
Soundkin authenticates you through Spotify's OAuth flow. You are responsible for keeping your Spotify credentials secure. We never see or store your Spotify password.
3. Permitted use
You may use soundkin only for your own personal, non-commercial enjoyment. You may not:
- Modify, edit, alter, create derivative works of, disassemble, decompile, or reverse-engineer the Service, any portion of it, or the Spotify Platform, Spotify Service, or Spotify Content accessed through it.
- Use any robot, spider, scraper, or other automated means to access the Service.
- Attempt to extract, download, or otherwise capture any audio, metadata, or other content delivered through the Service in a way that is not a normal in-browser interaction.
- Use the Service to harass, impersonate, defraud, or harm other users.
- Resell, sublicense, redistribute, or commercially exploit the Service.
4. Spotify Content
The Service displays content drawn from Spotify, including artist names, track ids, audio feature values, and similar metadata (“Spotify Content”). Spotify Content remains the property of Spotify AB and its licensors. You receive no rights to Spotify Content beyond what you would have through a normal Spotify account.
Soundkin is an independent third-party application. It is not affiliated with, endorsed by, sponsored by, or operated on behalf of Spotify AB.
5. Privacy
Your data is handled according to our Privacy Policy, which is incorporated into these Terms by reference.
6. Spotify is a third-party beneficiary
Spotify AB is a third-party beneficiary of these Terms with the right to enforce them against you. This clause exists because soundkin is built on Spotify's developer platform under Spotify's Developer Terms.
7. Disclaimer of warranties
The Service is provided “AS IS” and “AS AVAILABLE,” without any warranties of any kind. Soundkin and Spotify expressly disclaim all warranties, whether express, implied, or statutory, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and uninterrupted or error-free operation. Without limiting the foregoing, neither soundkin nor Spotify makes any representation or warranty on behalf of Spotify with respect to Spotify Content, the Spotify Platform, or the Spotify Service.
8. Limitation of liability
To the maximum extent permitted by law, soundkin will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to these Terms or the Service, even if advised of the possibility of such damages. Soundkin's total aggregate liability to you for all claims is limited to USD $50.
9. Termination
You may stop using soundkin at any time. To erase your data, use the “Delete my data” button on your fingerprint page or email privacy@soundkin.app. We may suspend or terminate your access at any time if we believe you have violated these Terms or if Spotify directs us to do so.
10. Changes
We may update these Terms. Material changes will be reflected by updating the “Last updated” date at the top of this page. Continued use of the Service after changes means you accept the new Terms.
11. Governing law
These Terms are governed by the laws applicable to where soundkin is operated, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts of that jurisdiction, except that either party may seek injunctive or equitable relief in any court of competent jurisdiction.
